Get Involved: DA - Oxford Art Factory - Remove condition restricting types of uses for venue

Oxford Art Factory (38-46 Oxford Street, Darlinghurst) has lodged another Development Application with Sydney City Council (D/2006/645/E) requesting removal of a development consent condition. The condition relates to the types of uses permitted for the venue. It originally specified that 3 different forms of entertainment must take place (such as live music, theatre, cabaret) and that the venue must not operate solely as a nightclub. The applicant is now seeking to delete this condition.

A similar DA was lodged in September 2008 requesting a reduction in forms of entertainment from 3 to 2. This was subsequently approved however the condition relating to the premises not being used solely as a nightclub remained intact. It is clear that this was imposed due to concerns regarding the significant negative impacts in the Oxford Street area due to the existing number of nightclubs and licensed venues.

It is understood that the Council's intention when originally approving this venue was for it to maintain 'a market orientation towards art, live performances and supporting cultural events and endeavours'. The applicant has another DA currently being assessed by Council for extended trading hours until 6am on a permanent basis.
