Get involved: DA and Intention to apply for a liquor licence - 31-33 Oxford Street (former DCM/UN premises)

Introduction

For Level 1 of the premises at 31-33 Oxford Street, The Art of Spice Pty Ltd

  • proposes to apply to the Casino, Liquor & Gaming Control Authority for a liquor licence; and
  • has submitted a Development Application (D/2009/915) to the City of Sydney

Many of you have already received the applicant’s Notice of intention to apply for a liquor licence or a licence authorisation.

The period to provide feedback to the applicant in relation to the proposed liquor licence application ends on 24th July 2009.

The Development Application is on public exhibition until 22nd July 2009.

So now’s the time to have your say on both.


Liquor Licence Applications

An application for a new permanent liquor licence should be accompanied by:

  • A Community Impact Statement (CIS), which summarises the results of consultation with the local community about any issues with the proposed application. Many of you have already received the applicant’s Notice of intention to apply for a liquor licence or a licence authorisation.
  • A copy of the council's development consent or approval for the proposed premises.

The application can't be granted unless the Authority is satisfied that the overall social impact won't be detrimental to the well-being of the local or broader community. In determining the application, the Authority considers the CIS, the application, any other submissions made, and reports from the police.


The applicant

The Art of Spice Pty Ltd currently trades as the Tandoori Palace - the Indian Restaurant and Karaoke Party Room at 86 Oxford Street.

Another restaurant and function centre - the Mediterranean Sydney - is now proposed at the 31-33 Oxford Street.


The applications

(1) Proposed Liquor Licence

The circulated Notice of intention to apply for a liquor licence or a licence authorisation proposes the following activity:

  • Trading Hours - 12 noon - 2am (next day), 7 days a week
  • Restaurant with live entertainment
    • Mediterranean cuisine
    • Dancers, DJ music, dancing area, 2-3 piece band, singers
    • Special guest appearances, multi-purpose entertainment restaurant
    • Dancing, cooking and language classes on various nights
    • Private functions on various nights
  • Number of patrons - 400
  • The venue's new website cites parties and functions such as:
    • Hen's nights
    • Buck's nights
    • Christmas parties
    • Get-togethers
    • Corporate functions
    • Special occasions
    • Nights-out
    • More ......

(2) Development Application

The DA seeks:

  • Approval to use Level 1 as a restaurant, bar and function venue
  • Extension of the existing PoPE (Place of Public Entertainment) licence to 2am each day. The current PoPE approval for the premises permits entertainment until midnight daily
  • Renewal of the PoPE licence, as it expires in October 2009
  • 400 patrons – also as per exiting approvals for the premises

What you can do

  • Proposed Liquor Licence

    You can provide feedback directly to the applicant, for inclusion in the CIS submitted with the liquor licence application, by 24th July 2009.

    You can make a submission directly to the Casino, Liquor & Gaming Control Authority once the liquor licence application is submitted. We’ll let you know if, and when, this happens.

  • Development Application

    Let Council know what you think by making a submission before 22nd July 2009. You can do this by either:

    • Completing the online submission form   - You might find it easier than having to write a formal letter - and if you do it now it'll only take a few minutes and then it's done(!); or
    •  Emailing your submission to Peggy Wong, the Council planning officer managing this application
  • Forward a link to this page to your neighbours and encourage them to have their say.
